These Terms of Service govern your use of the SaaS product provided by MB Kauno studija (“Company,” “we,” “our,” or “us”). By accessing or using the service, you agree to be bound by these terms. If you do not agree, you must not use the service.
1. Eligibility
You must be at least 18 years old to use the service. By using the service, you represent that you meet this requirement.
2. User Accounts
- To access certain features, you must create an account by providing accurate and complete information, including username, first name, last name, email address, and avatar picture.
- You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.
- You agree not to share your account or allow others to access it.
3. User Content
- You may create maps and positions within the service.
- By creating or sharing user content, you grant us a worldwide, non-exclusive, royalty-free license to store, display, and process such content for the operation of the service.
- If you choose to make your content public, you understand that it will be visible to others and may be copied, shared, or used by third parties outside our control.
4. Data Retention and Deletion
- If you delete your account, we will remove personal data (as described in our Privacy & Cookie Policy).
- Anonymized or aggregated data may remain in our systems for analytics and business purposes.
5. Acceptable Use
You agree not to:
- Use the Service for unlawful purposes.
- Attempt to gain unauthorized access to the Service or other accounts.
- Distribute malware, spam, or harmful content.
- Infringe the intellectual property rights of others.
We reserve the right to suspend or terminate accounts that violate these rules.
6. Third-Party Services
The Service integrates third-party services:
- Google Analytics (analytics services)
- Mapbox (map rendering and geolocation services)
- OpenAIP (aviation data and related information)
Your use of these features is also subject to the respective providers’ terms and privacy policies. We are not responsible for their practices.
7. Intellectual Property
- All rights in the service, including software, design, and branding, are owned by MB Kauno studija or its licensors.
- Except for your user Content, you may not copy, modify, distribute, or create derivative works without prior written permission.
8. Disclaimer of Warranties
The service is provided “as is” and “as available” without warranties of any kind, whether express or implied. We do not guarantee that the service will be error-free, secure, or uninterrupted.
9. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, or consequential damages.
- Our total liability for any claim arising from your use of the service will not exceed the amount (if any) you have paid us in the last 12 months (currently the service is free).
10. Termination
We may suspend or terminate your account at any time if you violate these terms or if required by law. You may stop using the service and request account deletion at any time.
11. Governing Law
These terms are governed by the laws of Lithuania and the European Union. Any disputes will be resolved in the competent courts of Kaunas, Lithuania.
12. Changes to Terms
We may update these terms from time to time. Changes will take effect immediately upon posting on the service. Continued use constitutes acceptance of the updated terms.
